What is Protect Duty (Martyn's Law)?
Protect Duty — often called Martyn's Law — is the Terrorism (Protection of Premises) Act 2025, UK legislation that places a legal obligation on those responsible for certain venues and events to take proportionate steps to keep the public safe from terrorist threats. Named after Martyn Hett, who was killed in the Manchester Arena attack, it creates clear duties for qualifying venue operators, organisers and local authorities. Does Protect Duty apply to my organisation?
The duty applies to operators of qualifying venues with a capacity of 200 or more, and to events and public spaces that meet relevant thresholds. The scope is broad — covering schools, councils, hospitality, retail, entertainment, CNI and more. What is the difference between Standard and Enhanced Duty?
The Standard Tier applies to venues with a capacity of 200–799 and focuses on developing and implementing security procedures. The Enhanced Tier applies to venues with a capacity of 800 or more and requires more structured risk assessment, documented security plans and formal engagement with the regulator. Both tiers carry genuine accountability at leadership level.
When does Protect Duty come into force?
The legislation received Royal Assent in 2025. A phased commencement period is expected, giving organisations time to prepare before full regulatory enforcement begins. However, waiting until enforcement is not a defensible position — the duty of care to protect the public exists now, and the time to understand and act on your obligations is before they become legally mandated. Why do I need independent advice rather than just following government guidance?
Government guidance tells you what is required — it does not tell you whether your specific organisation is compliant, proportionate and defensible. Independent advisory translates generic legislative requirements into a structured assessment of your actual position, with a written record that demonstrates sound decision-making. For senior leaders with personal accountability, that distinction matters significantly.
What does a Readiness Review actually involve?
Our Readiness Review is a structured, senior-led assessment of your organisation's current position against Protect Duty requirements. It involves a site visit and governance review, a gap analysis against legislative obligations, and culminates in a written report with an executive summary and prioritised recommendations — presented directly to your leadership team. It is the starting point for any organisation serious about reaching a defensible position.
